On January 15, 2025, the FDA formally banned the use of FD&C Red #3 (Red 3) Food Dye, as it identified a link between it and possible cancer in laboratory animals.
The FDA will no longer permit the use of FD&C Red #3 in food and ingestible items
Red 3 is common in many confectionery items. FD&C Red 40 is more commonly used, and according to the FDA, there is no current issue with its continued use.
Manufacturers will have until January 15, 2027, and January 18, 2028, to reformulate their products.
As long as the product was manufactured before the cut-off date, there is a strong likelihood that consumers will continue to see these ingredients after the effective date, and this is NOT a sign that the product is defective or unsafe for consumption.
Although we are an independent wholesaler, not a manufacturer, we are aware of this regulatory change.
We will diligently check the ingredients of our candies, but our vendors will have about two years to make the necessary changes. As we all know, the wheels move slowly in the candy industry.
If in doubt, we recommend that customers review the current ingredient labels to determine whether a product meets the FDA guidelines as described above.
